Texas Uber & Lyft Accident Lawyer
Insurance companies have their own lawyers. You should too.
A rideshare crash is not an ordinary car accident. Depending on what the driver was doing in the app, the coverage can range from a personal auto policy to $1 million in commercial insurance. Alers Law helps injured passengers, other drivers, cyclists and pedestrians across Texas pursue the full compensation they deserve, all the way to trial if necessary.

Who We Help
- Passengers hurt while riding in an Uber or Lyft.
- Other drivers hit by a rideshare vehicle.
- Pedestrians and cyclists struck by a driver on the app.
- Rideshare drivers hurt by another driver.
Which Insurance Pays Depends on the App
Texas law sets minimum coverage for rideshare drivers based on what they were doing at the moment of the crash (Texas Insurance Code, Chapter 1954).
| Driver's status in the app | Minimum coverage under Texas law |
|---|---|
| App off | The driver's personal auto policy only |
| App on, waiting for a ride request | $50,000 per person and $100,000 per incident for injuries; $25,000 for property damage |
| On the way to a pickup, or carrying a passenger | $1,000,000 total for death, bodily injury and property damage |
Insurers often dispute which period applies. We request the app data and the trip records early, before they are lost, to show which policy should pay.
What Compensation Can Cover
Depending on your case, compensation may include medical bills and future care, lost wages and earning capacity, pain and suffering, mental anguish and property damage. When a crash takes a life, the family may bring a wrongful death claim. Every case is different, and we cannot promise any result.
What to Do After a Rideshare Accident
- Call 911 and get medical care, even if you feel fine.
- Take screenshots of the trip in your app: the driver's name, the car, the route and the time.
- Photograph the scene, the vehicles and your injuries. Get witness names and numbers.
- Report the crash in the Uber or Lyft app, but keep it short and factual.
- Do not give a recorded statement to any insurer before speaking with a lawyer.
- Call us. Rideshare companies and their insurers move quickly. So should you.
Texas Deadlines and Fault Rules
In most Texas injury cases, you have two years from the date of the crash to file a lawsuit (Tex. Civ. Prac. & Rem. Code § 16.003). Under Texas's modified comparative fault rule, your compensation is reduced by your share of fault, and you cannot recover if you are found more than 50 percent responsible. Passengers are rarely at fault, but insurers may still try to shift blame between drivers.
Fees
You pay no attorney fee unless we recover compensation for you. We explain the fee and any case expenses in plain terms before you decide.

FAQs
Does Uber or Lyft pay for my injuries?
Often the rideshare company's commercial policy applies, but only during certain periods in the app. If the driver was offline, the driver's personal policy usually applies instead.
I was a passenger. Do I have a claim?
Usually yes. A passenger is rarely at fault, so the question is which driver and which policy are responsible.
What if the other driver caused the crash?
You may have a claim against that driver's insurance, and the rideshare policy may also provide uninsured or underinsured motorist coverage, depending on the facts.
How long do I have?
In most cases, two years from the crash. Evidence such as app data can disappear much sooner, so call early.
Do you handle rideshare cases outside DFW?
Yes. We represent injured people throughout Texas, in person in DFW or by phone and video statewide.
